1. Universal Application of Platform Conditions

This Agreement applies to every user irrespective of geographical location, nationality, residence, language, caste, religion, community, ethnicity, region, social background, or any other personal attribute.

Users who access the Platform from outside India or communicate in any language are responsible for complying with their local laws, but they must also comply with this Agreement, Platform rules, and applicable Indian law. If any user cannot comply with these conditions, they must stop using the Platform.

For the purposes of this Agreement, these conditions apply at all times to natural persons, family members, representatives, organizations, automated tools, scripts, crawlers, bots, AI systems, AI agents, non-human access methods, and any person or system acting directly or indirectly through a user account or Platform access point.

2. Acceptance of Agreement

By accessing, registering, or using the Platform, you ("User") agree to be bound by these Terms & Conditions, the Privacy Policy, the Cookie Policy, and the Disclaimer (collectively, the "Agreement"). If you do not agree to these terms, you must immediately cease using the Platform.

Sampoorna Matrimony may update this Agreement from time to time. Continued use of the Platform after the updated terms are posted or notified will be treated as acceptance of the updated Agreement.

3. Eligibility for Registration

We may refuse registration, request additional information, or suspend access if we believe a profile is ineligible, misleading, unlawful, unsafe, or created without proper authority.

4. Profiles Created by Relatives or Representatives

If you create, manage, or communicate through a profile on behalf of a relative, family member, friend, or any other person, you confirm that you have that person's informed consent and authority to share their information on the Platform.

You are responsible for ensuring that all information, photos, contact details, documents, and communications submitted on behalf of another person are accurate, lawful, and authorized by that person.

5. Role as an Intermediary

Sampoorna Matrimony acts as an "Intermediary" as defined under Section 2(w) of the Information Technology Act, 2000. Our role is limited to providing a platform for members to upload profiles for the purpose of matchmaking.

The Platform only facilitates introductions and discovery between users. We do not guarantee marriage, engagement, compatibility, profile responses, successful matches, family acceptance, or the truthfulness of any user statement.

Important: Verification checks, if performed, are limited checks only and must not be treated as a complete background verification. We do not independently verify a user's character, marital history, employment, education, income, family background, health, financial position, immigration status, horoscope, or other personal claims.

Users are solely responsible for conducting independent due diligence before sharing private information, making payments, meeting offline, entering into an engagement, or proceeding with marriage discussions.

6. User Conduct & Responsibilities

Sampoorna Matrimony does not support, promote, encourage, or tolerate discrimination, hateful speech, malicious intent, abuse, harassment, exploitation, coercion, threats, intimidation, blackmail, predatory behavior, or any unlawful or undesirable conduct. Users are responsible for the consequences of their own actions, communications, meetings, and decisions.

Users are strictly prohibited from:

• Uploading obscene, defamatory, hateful, threatening, sexually explicit, religiously sensitive, caste-abusive, or unlawful content.
• Discriminating, abusing, insulting, excluding, threatening, or targeting any person based on caste, religion, language, region, nationality, ethnicity, family background, disability, health condition, gender, marital status, financial status, or any other personal attribute.
• Creating fake profiles, impersonating another person, hiding an existing marriage, or misrepresenting age, identity, gender, marital status, education, employment, income, family details, or health information.
• Uploading forged, edited, misleading, or unauthorized documents, photographs, biodata, horoscope, or contact information.
• Demanding, promoting, negotiating, or facilitating dowry or any other unlawful consideration.
• Using the Platform for escort services, dating unrelated to matrimonial intent, trafficking, prostitution, commercial solicitation, recruitment, marketing, political campaigning, or any non-matrimonial purpose.
• Harassing, stalking, or sending unsolicited messages to other members.
• Requesting money, gifts, loans, investments, bank details, OTPs, passwords, identity documents, or other sensitive information from another user for fraudulent or suspicious purposes.
• Using the Platform, its users, profiles, matches, photos, communications, families, communities, or any Platform-related subject for betting, gambling, wagering, speculative games, contests, or any similar activity.
• Creating, publishing, forwarding, or spreading misinformation, false statements, malicious rumors, gossip, breach-of-trust allegations, or defamatory content about Poornata Technologies Private Limited, Sampoorna Matrimony, its team, users, profiles, families, matches, communities, or Platform-related subjects.
• Uploading, submitting, or using AI-generated, synthetic, deepfake, edited, or machine-created content as genuine profile content, identity material, photographs, documents, biodata, messages, or other user information.
• Misusing contact information obtained through the Platform for non-matrimonial purposes.
• Scraping, copying, harvesting, selling, or distributing user profiles, photos, phone numbers, emails, or other Platform data.
• Using bots, automated tools, reverse engineering, security testing, or other methods that may harm, overload, copy, or interfere with the Platform.

We reserve the right to take appropriate legal action, including civil, criminal, regulatory, or law-enforcement action, against users who misuse the Platform, harm other users, submit false information, engage in fraud, violate applicable law, or create safety, reputational, or legal risk for the Platform.

Any misinformation, malicious gossip, breach-of-trust allegation, false statement, or reputational harm directed at the company, Platform, users, profiles, families, communities, or Platform-related subjects may be treated as defamatory or unlawful conduct, and action may be taken under applicable Indian law.

7. User Content, Photos & Profile Information

You are responsible for all information, photos, documents, messages, preferences, and other content submitted through your account ("User Content"). You confirm that you have the legal right and permission to upload and share such User Content.

We may remove, reject User Content that appears inaccurate, unsafe, unlawful, unauthorized, offensive or inconsistent with the purpose of the Platform.

Sampoorna Matrimony does not promote, encourage, or endorse AI-generated user content. We may reject, remove, restrict, or investigate any AI-generated, synthetic, deepfake, edited, manipulated, or machine-created content that is submitted as genuine user information or that may mislead other users.

8. Privacy, Consent & Data Protection

Your data is handled according to our Privacy Policy and applicable data protection laws. By using the Platform, you acknowledge that certain profile information, including photos, family details and other matchmaking information, may be visible to other registered members depending on Platform settings.

You must not upload personal data of any other person unless you have lawful authority and consent to do so. You may request correction, account deactivation, deletion through the available account tools or by contacting us. Certain information may be retained where required for legal, security, fraud prevention, dispute resolution, accounting, or compliance purposes.

If you submit a Govt ID or other verification document, you confirm that you are authorized to do so and acknowledge that document review is limited to identity review, safety, fraud prevention, dispute resolution, and compliance purposes. If you upload Aadhaar, you should upload a masked Aadhaar copy. Govt ID documents collected for identity review are deleted after the profile is verified. Such review does not constitute a background check, endorsement, guarantee, or assurance of any member's character, financial status, personal history, intentions, or suitability.

We may use service providers for hosting, analytics, communications, payment processing, fraud prevention, and customer support. Such processing will be handled as described in our Privacy Policy and Cookie Policy.

We apply reasonable security measures to protect user data. However, no online platform can guarantee absolute security, and to the fullest extent permitted by law, Poornata Technologies Private Limited and Sampoorna Matrimony will not be responsible for unauthorized access, data breaches, cyber incidents, technical failures, or loss of information that occur despite reasonable security measures or are beyond our reasonable control.

9. Paid Plans, Payments & Refunds

If the Platform offers paid plans or premium features, the price, duration, included features, taxes, renewal terms, and limitations will be shown at the time of purchase or on the applicable plan page.

Paid plans are for access to specified Platform features only and do not guarantee marriage, engagement, profile views, responses, contact acceptance, match quality, or any particular matrimonial outcome.

Fees are non-transferable. Refunds, cancellations, failed payments, duplicate payments, and chargebacks will be handled according to the refund policy displayed at purchase, applicable law, and the terms of the payment gateway or service provider.

10. User Safety, Offline Meetings & Financial Caution

Any offline meeting, relationship discussion, family negotiation, engagement, marriage, financial transaction, or personal exchange between users takes place entirely at the users' own risk.

11. Post-Marriage, Divorce & Personal Disputes

Sampoorna Matrimony is not a marriage registrar, family counselor, mediator, arbitrator, legal advisor, investigator, or representative for any user. If a relationship, engagement, marriage, separation, divorce, maintenance claim, custody issue, domestic dispute, property dispute, criminal complaint, or family proceeding arises between users, Sampoorna Matrimony will not represent, advise, support, or act on behalf of either party.

Users must obtain their own independent legal, financial, family, religious, or professional advice. The Platform is not responsible for post-match, post-engagement, post-marriage, separation, divorce, or family-law outcomes between users or their families.

12. Moderation, Suspension & Termination

We reserve the right to review, moderate, suspend, or terminate any account, profile, content, message, feature access, or membership if we believe that a user has violated this Agreement, created risk for other users, submitted false information, misused the Platform, or acted unlawfully.

We may also preserve relevant account information, communications, logs, documents, or reports where required for fraud prevention, user safety, legal compliance, dispute resolution, or cooperation with law enforcement authorities.

We are not required to disclose proprietary, confidential, security-sensitive, or internal policies, including moderation criteria, verification methods, fraud-prevention processes, risk scoring, investigation procedures, safety workflows, ranking logic, or internal interpretation of Platform rules. Subject to applicable law, interpretation, implementation, and enforcement of Platform policies remain at Sampoorna Matrimony's discretion.

13. Grievance, Reporting & Takedown Process

Users may report fake profiles, impersonation, harassment, abuse, fraud, unlawful content, privacy violations, intellectual property concerns, or other safety issues using the available reporting tools or by contacting the Grievance Officer listed below.

Reports should include the profile name or ID, screenshots where available, dates, message details, and a clear description of the issue. We may request additional information before taking action.

We will review reports in accordance with applicable law, Platform policies, and available evidence. Depending on the issue, we may remove content, restrict visibility, suspend accounts, preserve records, contact the reported user, or cooperate with appropriate authorities.

⚖️ Mandatory Takedown Timelines (IT Rules, 2021):

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Platform shall remove or disable access to any unlawful, obscene, or privacy-violating content within 3 hours (and within 2 hours for non-consensual sexual/intimate content or private images published without consent) of being notified by a court order or government authority, or upon receiving a valid user complaint under the designated categories.

🚨 Cybercrime Reporting & Penal Provisions (IT Act, 2000):

The Platform maintains a zero-tolerance policy towards cybercrime. We actively coordinate with law enforcement and will report offenders to the National Cyber Crime Reporting Portal (NCRP) at https://cybercrime.gov.in and state police departments. Offenders are subject to strict prosecution under the following sections of the Information Technology Act, 2000:

• Section 66C (Identity Theft): Punishable with imprisonment up to 3 years and a fine up to ₹1 Lakh for creating fake profiles or using personal data of another person.
• Section 66D (Cheating by Personation): Punishable with imprisonment up to 3 years and a fine up to ₹1 Lakh for cheating or impersonating any individual using computer resources.
• Section 66E (Privacy Violation): Punishable with imprisonment up to 3 years or a fine up to ₹2 Lakhs for capturing, publishing, or transmitting private images of a person without their consent.
• Section 67 & 67A (Obscene & Sexually Explicit Content): Punishable with imprisonment up to 5 years and a fine up to ₹10 Lakhs for publishing, transmitting, or sharing obscene or sexually explicit material.
• Section 72 (Breach of Confidentiality & Privacy): Penalty for unauthorized access or disclosure of personal data by associated personnel or intermediaries.

14. Account Security

You are responsible for maintaining the confidentiality of your login credentials, OTPs, devices, and account access. You must notify us immediately if you suspect unauthorized access or misuse of your account.

Sampoorna Matrimony will not be responsible for loss or harm caused by your failure to secure your account, sharing of OTPs or passwords, use of compromised devices, or unauthorized access that occurs due to your actions or omissions.

15. Third-Party Services

The Platform may use or link to third-party services such as payment gateways, SMS and email providers, analytics tools, maps, hosting providers, verification partners, or external websites. These services are operated by third parties and may be governed by their own terms and privacy policies.

We are not responsible for third-party websites, payment failures, gateway downtime, delivery failures, verification delays, analytics tools, or services outside our reasonable control.

16. Limitation of Liability

To the maximum extent permitted by law, Poornata Technologies Private Limited, its directors, employees, officers, contractors, affiliates, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, emotional, reputational, financial, or punitive damages arising out of:

• Any false or misleading information provided by users.
• Any match, rejection, communication, meeting, negotiation, engagement, marriage, separation, divorce, family dispute, or relationship outcome.
• Any physical, emotional, reputational, or financial harm resulting from interactions with other users.
• Fraud, impersonation, dowry demands, harassment, blackmail, misuse of information, or unlawful conduct by users or third parties.
• Technical failures, service interruptions, data loss, payment gateway issues, unauthorized access, or cyber incidents beyond our reasonable control.
• Actions taken in good faith to moderate content, suspend accounts, protect users, comply with law, or cooperate with authorities.

17. Indemnity

You agree to indemnify and hold harmless Poornata Technologies Private Limited, its directors, employees, officers, contractors, affiliates, and service providers from any claims, losses, damages, liabilities, costs, or expenses arising from your use of the Platform, your User Content, your violation of this Agreement, your false or misleading information, your misuse of another user's information, your discriminatory, abusive, malicious, fraudulent, or unlawful conduct, or any dispute between you and another user or third party, including post-match, post-engagement, post-marriage, separation, divorce, or family disputes.

18. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Hassan, Karnataka.
